The South African Human Rights Commission (SAHRC or Commission) has released its Position Paper on Access to a Basic Education for Undocumented Learners, inclusive of findings and recommendations addressed to the State. The release of this Paper follows an extensive consultation process with relevant stakeholders.

The South African Human Rights Commission (“Commission”) is convening again a subpoena hearing in terms of section 15(1)(c) and (d) of the South African Human Rights Commission Act 40 of 2013 (“SAHRC Act”), following the non-appearance of the Municipal Manager of the Thembisile Hani Local Municipality (“Municipality”) on 24 July 2019 and repeated failure of the Municipality to respond to allegations levelled against it by Mr Joseph Sibanyoni (“Mr Sibanyoni”) on 16 November 2018 and Ms Thembi Mahlangu (“Ms Mahlangu”) on 18 January 2019, respectively.

Tomorrow, 29 August 2019, the Equality Court sitting in the Randburg Magistrate’s Court will hear the South African Human Rights Commission’s (“the Commission”) hate speech case against Mr Adam Catzavelos. This application by the Commission follows Mr Catzavelos self-recorded video in which he makes racist remarks.

Over the years, the SAHRC Mpumalanga Provincial Office has received numerous complaints regarding undocumented learners, who have been denied access to schools due to lack of documentation. The Commission considers this continuing conduct from some schools as a gross violation of the rights of children enshrined in the Constitution.
